Online Auction Terms of Sale  

Thank you for participating in this Parks Auction online auction. The auction & conveyance of each property shall be governed by, and your registration (online or in person) evidences each bidder’s agreement with, the Contract for Sale at Auction, including all addenda, exhibits, disclosures, and other required documents (together, the “Contract for Sale”) and Sale Day Notes, Disclosures, the Parks Auction Co Terms of Service, and these Terms of Sale. Each of these documents govern your bid and the sale of each property. The Terms of Sale are non-negotiable and irrevocable. Good luck & good bidding.

In order to bid on the real estate or auction items, all bidders must have registered account as a member of parksauction.com and enrolled to bid on the specific property in question. There is no fee to create an account, however the Auctioneer reserves the right to revoke or enable bidding. By bidding you are representing to the Auctioneer and the seller that you have read and agree to be bound by all terms and conditions for this sale as stated herein. DO NOT BID unless you have read and agreed to be bound by the Contract for Sale, Sale Day Notes, Property Disclosures (if applicable), Parks Auction Co Terms of Service and the auction Terms of Sale as they are enforceable against you. You can find the Parks Auction Co general “Contract of Sale,” Terms of Sale & Parks Auction Co Terms of Service at ParksAuction.com/Terms.  Property specific terms & property disclosures can be found on the property of interest website page. The Contract of Sale and Terms of Sale are not subject to negotiation.

Contract of Sale Default

If the high bidder executes and returns the Contract and other required documents and the down payment, but fails to complete the transaction for ANY reason (including, but not limited to, remitting the total purchase amount), the high bidder shall relinquish ANY right to complete the transaction and shall have no rights or interest in the property, as well as forfeit all down payment monies as liquidated damages to Seller. PLEASE BE ADVISED: Tennessee statutes (and other various states) give the Seller the right to pursue legal actions against bidders who refuse to complete transactions. This may include (but not limited to) suit to compel completion of the sale, and/or criminal charges of fraud or other intentional act. 

The Auction Process

Bidding starts at the nominal Opening Bid(s) indicated and is open to all who registered and are approved. The Auctioneer will call the sale and control all increments of bidding (live/online). Online auctions will either be LIVE or TIMED for a pre-determined period of time. The Auctioneer reserves the right to extend bidding if overtime period is necessary.

The Auctioneer may start, stop, pause and re-open bidding at the Auctioneers sole discretion and shall serve as the sole arbiter as to who is or is not allowed to bid. The Auctioneer reserves the right to group, add to, delete, withdraw, consolidate or break down properties or quantities offered to sell out of scheduled, to reject any bid which is only a fraction advance over the preceding bid, to regulate bidding and to accept or reject any or all bids. Absentee bids may be accepted at the discretion of the Auctioneer. Any and all decisions if the Auctioneer regarding the order and conduct of auction shall be final and absolute without liability to any party. Seller reserves the right to cancel withdraw any property at any time.

As Is, Where Is Sale 

All properties are sold “As Is, Where Is” with no financing, inspections, or other contingencies to sale. Auctioneer represents the seller only and does not inspect properties on bidders behalf. Bidders must conduct their own due diligence and investigation of each property to determine the suitability of each parcel prior to placing bid. Bidders must rely solely upon their own investigation and not any information provided by the Seller or Auctioneer. Failure for a bidder to be fully informed on the condition of a property will not constitute grounds for a claim adjustment or to cancel the sale. All the information contained regarding the property was obtained from official county maps or other sources deemed reliable, but it not guaranteed and may be in error. Furthermore, the Auctioneer and Seller DO NOT WARRANT the accuracy thereof. Unless stated otherwise, Seller has made no independent investigation of any information provided, and assumes no responsibility for the providing of/or absence of any information, whatsoever, or for the accuracy thereof. Read the Contract of Sale and Property Notes/Disclosures to determine the existence of any disclosures, exclusions, representations and disclaimers. Do not bid if you have not inspected the property(s). By bidding you agree to all disclosures. Buyers will receive a good general warranty by seller.

Auctioneer and the seller expressly disclaim any liability for errors, omissions, or changes regarding any information provided for these sales. Please read the contract for sale, and property notes for a full and complete understanding of auctioneer and sellers disclaimers. Bidders are STRONGLY urged to rely solely upon their own inspections and opinions in preparing to purchase the property and are expressly advised to not rely on any representations made by the seller or their agents and employees. Property information may change without notice and potential purchasers should investigate all data fully before relying upon it.

You are entering into a binding contract. There are no refunds or bid cancellations. The registered bidder is personally responsible, legally and financially, for all auction items bid upon whether representing one’s self or acting as an agent. An online bid accepted at public auction is a legal and binding contract. Any bidder who fails to consummate a purchase will be banned from bidding at all future Parks Auction Co events and maybe pursued for civil and/or criminal violations.

What happens when you call Parks Auction Co. LLC?

First we evaluate your property and discuss with you the various options available for selling your property at auction. Next we present our findings, if the results are positive, a date is set for the auction. Then our auction team goes to work and advertising/marketing efforts begin.

  • Signs are ordered and posted.
  • Newspaper ads and promotional flyers are planned, created and placed. We create all advertising in-house to save time and ensure accuracy. Plus, our volume media discounts will help you save money.
  • Direct mail campaigns may be required to attract potential buyers. We maintain a growing mailing list of potential and interested buyers that request our information.

Q.  Doesn’t an auction cost me a lot more than listing my home?

Q.  What do I need to do to get my property ready to sell?
A.  Your auctioneer will give you a step-by-step approach for what needs to be done. This may include any number of items, such as cleaning, painting, surveying, landscaping, etc., to give your property the best possible appearance.

Q.  How much do you think it will bring? What if I don’t get offered what I want, do I have to sell it?
A.  The best answer is “Fair Market Value.” We don’t know what the property will bring until the sale is over. Through our marketing campaign, we ensure your property is showcased to all potential buyers in the marketplace the day of your sale. You, as the seller, reserve the right to reject the final offer.

Q.  Who will present the details of the auction to my seller?
A.  One of our auction professionals will accompany you and will present our auction program to your sellers. As you can see, it is very different from traditional brokerage and it does require a detailed presentation to the seller.

Q.  What is the first step in introducing the auction idea to my seller?
A.  Schedule an appointment for you and our auctioneer to meet with your sellers.

Q.  What is expected of me as a Listing Associate with a property in the auction?
A.  You are a very important part of the entire auction process. Your name and phone number will be listed in the auction ads so you will be receiving the majority of the calls about your property along with the auctioneer in charge.

Q.  As a Listing Associate, how will I be compensated?
A.  You always receive the listing side based on the auction high bid price. And, if you properly register a buyer who is the successful bidder at the auction, you will receive a referral on the sales side when offered.

Q.  Are all properties suitable for auction?
A.  Most properties, but certainly not all are saleable by auction. Residential property, commercial property, vacant land, even boat slips are sold at auction. The majority of sound developments that can be marketed effectively do extremely well at auction.

Q.  Why should I recommend the auction method to my customer?
A.  It depends on your seller’s needs. Any number of reasons. If the seller needs immediate action for the sale of their property. Some common reasons include a job transfer to another city, another home already purchased, absentee land owners (some may have inherited property but live in another city; they once lived here and thought they would come back but haven’t), 1031 tax exchanges where timing is an issue and farms that have been divided where multiple properties can all sell in one day. Very seldom do we hold an auction due to foreclosure. Sometimes, we do auctions in lieu of foreclosure.

Auction Buyer’s Guide

Auctions are unique – in experience, sound and practice – but are more common than some people realize.

Much of our daily lives are impacted by auctions. For example, the New York Stock Exchange controls the value of stocks, livestock auctions have an impact on the cost of food products and energy prices are determined at the Chicago Mercantile. The interest rate on money is even controlled by auctions. And, last but not least, we have all heard of eBay, where you can buy and sell almost anything!

The difference between eBay and Parks is that most of our auctions are live and on site. Many auction attendees find the experience addictive. They report that there’s nothing quite like the thrill of finding something they want and then bidding against others who want the same thing. However, you don’t have to be a seasoned auction attendee to be able to experience the thrill of auctions. Auctioneers across America are glad to welcome new bidders to their auctions. And though almost everyone has heard the old story about the person who attended an auction, scratched his nose and came home with an item he’d not intended to buy, pay no heed to that myth.

Feel free to just get your feet wet – don’t think you have to go to your first auction ready to bid.

You are welcome to attend any of our auctions to get a feel for how they are conducted. Watch and listen, then move on to bidding if that makes you comfortable. Our auctioneers will spend some time addressing commonly asked questions and explaining how the auction is going to work. Always remember to ask questions at our auctions if you don’t understand something. Our auctioneers and staff want people to continue to attend auctions, so we do all we can to encourage repeat business!

When you arrive at an auction site:

  • Register for a bidder number.
  • Read the terms printed on or displayed on posters, brochures or handouts.
  • Ask questions if you don’t understand a policy.
  • At our personal property sales, inspect the merchandise you’re interested in, as most is auctioned on an “as is, where is” basis. This means it is not guaranteed. When you buy an item, you become responsible for it.
  • Keep in mind that you’ll pay for the items you purchase before you leave the auction, even if you aren’t taking everything with you that day. We accept cash, check, MasterCard or Visa for your convenience.

At our real estate sales, most property is open for inspection two weeks prior to the sale by appointment or generally one hour prior to the auction. Terms vary per property; however, they generally include a specified amount of earnest money and a specified closing date. These terms are in all pre-printed materials and announced day of sale.

In order to bid at an auction, you need to make contact with the auctioneer or a ringperson.

A ringperson or ground man is someone who takes bids from the audience and then passes those on to the auctioneer. To bid, hold up your bid card, your hand or shout “yes.” The auctioneer or ringperson will make eye contact with you, take your bid and immediately turn and seek another bid. You can remove yourself from the process at any time by shaking your head “no” or saying “no” if the auctioneer or ringperson turns your way. If an auctioneer or ringperson misinterprets any of your signals, simply report the mistake right away.

At the conclusion of the auction make sure to take all of your items with you and pay the cashier before leaving. If your purchase involves real estate you will be asked to sign a contract and exchange earnest money.

Registering for ONLINE auctions 

  1. Navigate to the online auction or lot you wish to bid on, and click on the “SIGN-IN” button.  
     
  2. From here, you can click on the “Sign Up” link to create a new bidding account. This is also where you can reset your password, and sign in (if you have an existing account) to view the auction. 
     
  3. Follow the instructions by entering your first and last name, a valid email address, and a password at least 8 characters long.
     
  4. Accept the terms of use.   
     
  5. Once your bidding account is created with a username and password, you are now able to register for a specific auction. Navigate to the auction you wish to bid on, and click “REGISTER TO BID”.      
     
  6. Now, enter in your contact information, and click submit.
